Power of Attorney
A Power of Attorney is a legal document that gives another person the authority to make decisions on your behalf if you become unable to do so. In Ontario, there are two primary types, each serving a distinct and important purpose:
-
Power of Attorney for Property gives someone the authority to manage your financial affairs. This can include paying bills, managing bank accounts, selling property, or handling investments. It can take effect immediately or only if you become mentally incapable, depending on how it's drafted. You may appoint one or more attorneys and set out specific instructions or limitations.

-
Power of Attorney for Personal Care allows someone to make decisions about your health care, medical treatment, housing, and other personal matters if you are incapable of making these decisions yourself. This document only takes effect once you are deemed mentally incapable of personal care decisions, and it must be made voluntarily while you are still capable.
Having these documents in place is essential for future planning, especially in the event of illness, injury, or incapacity. Without them, your loved ones may have to apply to the court for authority to act on your behalf, which can be costly and time-consuming. We assist clients in preparing Powers of Attorney that are legally valid, tailored to their needs, and aligned with their personal values and preferences.
